CPRE reports on Newport

The CPRE has reported in its July 2013 eBulletin that ‘ The high court has weakened the sequential test at the heart of the town centre first policy. It dismissed a judicial review by Telford & Wrekin council against an inspector’s approval of an out-of-town superstore in Newport. The judge ruled that inspectors are not obliged to interpret the sequential test in a “rigid, mechanistic fashion. They are guidelines not tramlines.” The judge’s ruling throws light on how the sequential test and linked trips should be interpreted in future planning decisions . Ruling .
